"Charged in same-name savings account theft Richard Lee Gardner appeared Tuesday in District Court to be charged with stealing Richard Lee Gardner's savings from the First National Bank. In fact, police say, that very coincidence made the theft possible.
Defendant Gardner is a 23 year-old former Salinan now living in Springfield, Mo. Victim Gardner is a 32 year-old Lindsborg man.
Police say the defendant went to First National's HandiBank at 5th and Ash, identified himself as Richard Lee Gardner and said he wanted to close out his savings account. He filled out a withdrawal slip and walked off with the $1600 plus interest in the account.
The bogus withdrawal happened Feb. 6,, but was not discovered until the Lindsborg Gardner tried to withdraw $225 on March 3 and was told there were insufficient funds to cover the transaction. Soon signatures were matched against the month-old withdrawal slip and the crime was discovered.
By that time Salinan Garnder had become ex-Salinan Gardner. Further probing showed the defendant had a checking account at the bank, but no savings account.
The bank reinstated the full amount to the Lindsborg man's account making First National the listed victim of the grand theft by deception charge filed against the ex-Salinan. A warrant issued.
Monday the defendant walked into the Salina police station and surrendered. Following his court appearance, he was jailed in lieu of $2,000 bond to await a preliminary hearing."--4 Apr 1979, The Salina (KS) Journal

"Pleads guilty to stealing man's savings Richard Lee Gardner pleaded guilty Thursday to stealing the savings account of Richard Lee Gardner.
Appearing in District Court, the 24 year-old formmer Salinan admitted a charge of grand theft by deception for withdrawing the account of a 32 year-old Lindsborg man who happened to have the same name.
The defendant, who now lives in Springfield, Mo., told Judge Raymond Haggart he did not go to the First National Handi-Bank at 5th and Ash last Feb. 6 intending to steal money, ,but to close out his own savings account which had about $15 in it. He later discovered his ex-wife already had closed out the account.
But when he gave the teller a withdrawal slip, the teller gave him the $1642.29 that was in the Lindsborg man's account.
"I didn't say anything," Gardner told the judge Thursday. "I just went ahead and took it." He said he needed money to pay bills and cover his move to Springfield.
Gardner turned himself in to the police two months later. The bank had by then reinstated the Londsborg man's account.
Haggart sentenced Gardner to 1 to 5 years in prison,, then granted a three-year probabtion during which the defendand must repay the stolen amount to the bank."--7 Oct 1979, The Salina (KS) Journal
